Motorist spared driving ban

Our Criminal law team have made a successful application at the Sheffield Magistrates Court, resulting in a driver avoiding disqualification.

 

A recent speeding offence would have meant the driver would have reached 12 points and hence be subject to a disqualification under the totting up of points rule.

 

Pleading his case the team explained to the court that the drivers own business, which he had built over 12 years, relied on his ability to be able to drive.

 

The application was successful on the grounds that the loss of his licence would cause exceptional hardship to his family.
