What is the Personal Injury Claims Process?
The personal injury claims process might seem daunting and the timeline can vary but most claims follow a set process:
- You appoint a representative - To start a claim you can contact us on 0161 665 3502 where we will discuss the circumstances of your accident and make an assessment on whether it is something our specialist personal injury solicitors can help with,
- Evidence gathering and claim notification – Once the case has been accepted, we will work with you to put together evidence to prove your claim and notify the insurer of the party responsible,
- Medical report - We will arrange for you to have an independent medical examination where the full extent of your injuries will be assessed, and recommendations will be provided on what kind of treatment you may need to undergo,
- Settlement negotiations – Your case and all evidence will be presented to the insurers for review at which point a settlement figure may be agreed,
- Court - If an out if court settlement cannot be agreed, we will represent you in court and a judge will decide who was to blame and how much compensation should be awarded,
- Payment - You will be awarded compensation for your personal injury.
How long do you have to make a personal Injury claim?
You normally have 3 years to start your personal injury claim. There are exceptions to the 3-year rule and sometimes the time limit is shorter. If you think you might have a claim, it is important you contact us as soon as possible.
Can I make a No win No Fee personal injury claim?
Garratts Solicitors offer their personal injury claims services on a “No Win No Fee” basis if you do not already have legal cover through other means e.g. Trade Union membership. This means there is no risk to you in pursuing your claim. Our solicitors will organise an initial interview with you to review your claim and advise you as to where we believe you have a case.
There may be cases where a claim is unsuccessful, but under the “No Win No Fee” agreement we will not charge you for our time, and your insurance policy will cover your opponent’s legal fees and costs. An exception to this rule will be made if the Court decides that you have acted dishonestly in making the claim. In this case, you might be liable to pay costs.
How much will you have to pay if you win?
If you do win your personal injury claim, the other party will be responsible for paying your legal costs. Any legal costs that are not covered are deducted from your compensation. Garratts do charge a “success fee”, which compensates us for the risk that if your claim was unsuccessful then we would not be paid at all (this is capped at 25%). Your solicitor will discuss this with you in advance of proceeding with your claim, so you will know what to expect.

How long does a personal injury claim take to settle?
In the majority of cases, you have three years from the date of your accident to settle your claim or issue court proceedings. Whilst straightforward personal injury claims can take just weeks to settle, more complicated cases will take months, and sometimes even years. The time it takes for the personal injury settlement process depends on your individual case. The complexity, number of parties involved, and severity of your injuries all make a difference. The sooner you start the process, the sooner you will get an outcome and the less likely you are to miss the personal injury claim time limit.
