Trip and Fall Claim - Success Story

Mrs S was on holiday when she suffered a fall whilst shopping at a local Agricultural Merchants. She was passing from the car park to an area where plants were being held for sale when she tripped.

The floor area was very uneven and there was a two inch difference in height between the car park and the paved shop area which was unmarked and no warning signs were in place to warn of the hazard.

She was seen at the local hospital and various tests were carried out. She suffered a head injury and was therefore kept in hospital overnight. The next day she was informed that she had suffered a fracture to her wrist which would require surgery as well as injuries to her head, right eye and cheek, shoulder, knee and foot. Her wrist was in a cast for several weeks and she developed frozen shoulder as a result of the fall.

She underwent physiotherapy sessions and cortisone injections for the shoulder. Mrs S was unable to drive for some time and was dependant on relatives to assist her with general chores and daily tasks. The Agricultural Merchants had a duty to provide a safe environment for its customers which they failed.

Consequently this was actionable and Garratts secured compensation for Mrs S in the sum of £7,500.
