Garratts has successfully achieved an admittance of fault for a man who underwent knee replacement surgery at his local hospital. The surgery was not successful; the wrong knee implant was used and the client suffered from severe infection thereafter. The client underwent extremely painful revision surgery when an alternative replacement knee was implanted. Unfortunately, this was also unsuccessful and despite several further unsuccessful operations to deal with additional infections, a third implant was installed.
This operation was negligent and as a result severe further infection followed and the client's leg went septic. The client underwent amputation to prevent the spread of the infection but unfortunately the amputation was subsequently insufficient and a second amputation to remove further and above the knee joint was necessary.
Medical evidence was obtained by us to support our client's claim which indicates that even the first knee replacement surgery was probably unnecessary. Liability has been admitted by the Trust responsible and we are currently negotiating on damages.
This is likely to result in our recovering damages of exceeding £1,000,000.
