Mr M consented to this operation as he was led to believe it would be a success.
After the operation, however, the deformity in the finger persisted and he also developed discomfort and pain. He was referred back to the Surgeon and eventually the finger was amputated.
The Surgeon did not advise Mr M of the risks of the operation, and it should have been noted that the deformity from which Mr M suffered rarely responds to treatment. Â Had Mr M been fully advised of the risks and benefits of the surgery, it is likely he would not have undergone the operation. Mr M would not have unnecessarily suffered two years of pain and the finger would not have been amputated.
Mr M was successful in his case and was awarded compensation in the sum of £13,000.00.
