During the period of his employment with the Defendant, the Claimant gradually noticed a diminished level of fitness together with slightly reduced exercise tolerance. He experienced chest tightness and a number of chest infections.
Following referral for respiratory assessment he was diagnosed with Occupational Asthma following exposure to chemicals including Vanodine Hard Surface Cleaner, Vanodine Concentrated De-oderiser, TTC Toilet De-scaler and Blue Magic Multi-Purpose Cleaner.
The Defendants failed to ensure any suitable personal protective equipment (a face mask) was provided to the Claimant and following repeated exposure to the above hazardous chemicals the Claimant developed Asthma.
Despite a vigorous Defence put forward by the Defendant authority, a settlement was eventually reached in favour of the Claimant.
