Garratts have successfully obtained compensation for a Mr A on behalf of his Deceased Wife (W), who died prematurely as a result of the negligence of a local care home. W suffered with dementia and as a result often spent short periods of time in the home to allow respite for her Husband, who was her carer. On one occasion, W sustained a fall whilst in the care home, and this resulted in a fractured shoulder and hip injury. The care home unfortunately decided to take W to hospital via taxi which meant moving her before they knew what injuries had been suffered. This resulted in unnecessary pain and suffering. The Claimant through his father applied to be admitted as a member of the Defendant's gym and paid a monthly fee for doing so. Following his induction the well-known national gym appointing a Personal Trainer who at all times would assist the Claimant when attending the gym. The Claimant was an especially vulnerable person dependent on the Defendant's protection against a risk of injury when using the gym.
