Garratts obtained supportive medical evidence from a Consultant Obstetrician who confirmed that the two superficial cuts were not caused by negligence but the third, deeper cut, could have been avoided had reasonable care been taken. The third cut was therefore caused as a result of a breach of duty of care and was negligent in that the Consultant performing the caesarean section cut too deeply with the scalpel when trying to enter the uterus.
It became apparent shortly after I's birth that he was going to suffer scarring as a result of the injury and once supportive medical evidence had been obtained from a Consultant Obstetrician, a report was sought from a Consultant Plastic Surgeon regarding the scarring and its permanency.
Evidence from a Plastic Surgeon showed that I would have the scar which was around 4.5cm for life and although it may fade slightly as he ages that it would also increase with size as he grows.
I was aged 5 at the time of settlement and was successful in being awarded damages in the sum of £6,000.00 for his injuries.
