Mrs B suffered a corneal ulcer which led to her attendance upon the Defendant Trust. The negligence in Mrs B’s case was two-fold involving misdiagnosis and subsequent negligent mistreatment.
Misdiagnosis: A Critical Error
The Defendant Trust misdiagnosed Mrs B as to be suffering from a corneal foreign body rather than a corneal ulcer. Based upon this incorrect diagnosis the Defendant Trust made attempts to removal the supposed foreign body with both cotton buds and a needle resulting in pain, injury and long-term deterioration to Mrs B’s eyesight.

Garratts Solicitors obtained supportive expert evidence, from a leading Ophthalmologist, on behalf of Mrs B which identified that both the misdiagnosis of the corneal ulcer and the attempted removal of the supposed corneal foreign body constituted negligence. Importantly, it was concluded that the correct diagnosis would, on the balance of probabilities, have led to Mrs B receiving the correct treatment and the pain, injury and long-term deterioration of her eyesight being avoided.
