Mrs C was told by her dental surgery that she needed to have her back, left tooth extracted. She was referred to another dental surgery for the extraction to be performed. The process was very traumatic and when Mrs C returned to her car she noticed that the wrong tooth had been removed.
The situation was such that not only was a perfectly healthy tooth removed, it also meant that the affected tooth remained in-situ. Mrs C was traumatised by the ordeal and therefore did not want to proceed to have the correct tooth extracted which meant that she struggled with pain for a significant period of time.
She was also very self-conscious of the issue as it was very obvious when she smiled.
It became apparent that there had been a mix-up in the referral paperwork and unfortunately the only way for Mrs C to get redress was to commence legal action.
At Garratts, we were able to obtain supportive expert evidence from a dental expert who confirmed that the treatment was negligent. We were also able to understand what future treatment was required to remedy the situation.
An out of court settlement was eventually agreed on behalf of Mrs C in the sum of £17,000.
