Ms B underwent a Radiofrequency Ablation/Facet Rhizotomy procedure on a private basis. The procedure involves injections/probes being inserted into the spine which produces radio waves to the nerves to decrease the pain signals into targeted areas.
There were six injections in total and five were inserted with no issues. The sixth injection, however, led to immediate pain and a burning sensation. It became apparent that the sixth probe had been misplaced and it had to be removed and reinserted.
Within days of the procedure having taken place, Ms B developed swelling, bruising and a burning sensation below her right knee. She was subsequently advised that she had sustained permanent nerve damage as a consequence of the above procedure.
The nerve damage is permanent and significantly affects Ms B on a day to day basis.
Garratts were able to obtain expert evidence which showed that the surgical error represented a breach of duty of care and amounted to clinical negligence.
An early settlement was achieved for Ms B in the sum of £20,000.
