The Claimant suffered from a range of learning and physical difficulties and was a protected party. The Claimant through his father applied to be admitted as a member of the Defendant's gym and paid a monthly fee for doing so. Following his induction the well-known national gym appointing a Personal Trainer who at all times would assist the Claimant when attending the gym. The Claimant was an especially vulnerable person dependent on the Defendant's protection against a risk of injury when using the gym.
